法庭內外不該牽涉太多「政治」
「蘋果国安案」第137日審訊，控方引用黎智英2020年6月專欄文章〈窒息中的香港人 逃亡還是抗爭〉，有一句說「國安法不僅把香港變成沒有自由法治的一般大陸城市，甚至會是新疆一樣恐怖籠罩下的集中營，怎不令香港人害怕」，控方質疑這個說法毫無根據。
黎智英反問控方：「你撫心自問，現在香港有沒有人能說真話？」法官杜麗冰連忙打斷黎，指他並非回答控方問題，更說：「我不會容許任何政治言論。」黎說自己沒發表政治言論；杜麗冰即提醒他，問題是關於文章刊出的時候，不指現在。黎回應OK，末了只好承認沒有「根據」。
看了這則法庭新聞，我有兩點感想，其一是關於「根據」二字——法庭到底需要什麼「根據」呢？按照杜麗冰的說法，所謂「根據」，大概指黎撰寫專欄時已發生的事實，或一些基於事實的推論，而非無中生有的猜想或感受。
以上述專欄文字為例，當中其實涉及三個重點：（一）沒有自由法治的一般大陸城市；（二）類似新疆的恐怖籠罩下的集中營；（三）国安法將把香港變成（一）及（二）的情況。也許控方心中只想問（三），而黎智英也可能不自覺地代入控方角度，只留意（三），沒想過自己也可嘗試回應（一）和（二）。
（一）和（二）的「根據」，在中国新聞、外媒報道俯拾即是。若（一）和（二）成立，作為中国一部分的香港怎可能獨善其身？當然我得指出，要求專欄作者交代想法的「根據」，本身就很荒謬。專欄不同社論，主觀色彩和個人風格比較強烈，它的特色就像昔日香港著名專欄作家十三妹所說：
「我們的時代，節奏如此其繁，於是自必影響文章。猶若一道河流，滔滔滾滾，泥沙碎石微生物，哪來得及為之一一換出與釐清？我們的思想感情，四面八方而來，什麼來到筆下就寫將出來，此之謂曰專欄，我們的時代，蓋作者之所思所感所受者也。」（見於1962年〈從行家使我發嘔想換版頭名稱談開去〉）
以報刊方塊文章標準來說，黎智英認為国安法可怕，擔心它將令香港變得面目全非，這根本不需要別的「根據」（當然有也無妨）支持，他自己的「所思所感所受」已是充分的根據。何況事隔數年，就算當日想法真有什麼根據，現在早已記不清，又如何在法庭解釋？
例如同日審訊中，控方向黎智英出示2020年7月9日的「Live Chat with Jimmy Lai」節目謄本，黎稱国安法凌駕基本法，使香港失去自由法治。控方又問黎有何根據。黎稱国安法有條文規定，若国安法與基本法有牴觸，則以国安法優先。控方隨即反駁說，国安法沒有提及基本法。黎以為自己錯了，說：「我當時以為這是事實，我搞錯了。」
其實黎智英當時的說法正確，只是隔了五年，他一時記錯「国安法有條文規定」可凌駕基本法，才被控方有隙可乘。国安法當然不會有條文這樣說，但現任律政司司長林定國在2021年7月20日演講（當時林只是資深大律師，尚未升任律政司司長），題為「對香港國安法的謬誤」，他預備的PowerPoint第9頁解釋「基本法」和「国安法」的關係，跟黎智英所說的「凌駕」是一樣的：
「《基本法》和《國安法》兩者都是由全國人大主導制定，因此可以把它們視為同位法，是兄弟關係。《基本法》對香港作全面的規定，而《國安法》則專就維護國家安全這一特定事項作規定，故有學説形容《國安法》是《基本法》的特別法，基於特別法優於一般法的原則，《國安法》和《基本法》如有不一致的地方，則優先適用《國安法》。」
這鏈結就是「根據」：
除了「根據」，相信大家都留意到「政治」兩字。杜麗冰官威十足地說：「我不會容許任何政治言論。」但諷刺的是，上月杜麗冰本人才發表政治言論：當時黎智英作供，提及自己曾在直播節目說，拜登政府應容許台灣加入日本、澳洲及印度，成為「四邊安全對話」成員國。
杜麗冰隨即質疑，據黎早前說法，台灣不是主權國家，又如何能成為成員國？她更以「父子關係」比喻兩岸：「孩子不是獨立於你，但孩子卻對另一對父母說『看，你最好從我的父親手中保護我』，那怎可能行得通？」（錄自《庭刊》報道）
聽見這種比喻，我也想問杜麗冰有何「根據」——中華民國今年114歲，中共国才76歲，若非「政治言論」，怎會把台灣比喻為中国的孩子呢？也許，今天香港所謂「政治言論」只是一個委婉語，說穿了，不過代表一切「不利於中共的論述」。至此，我終於真正明白2018年容海恩金句「議會內外都不應該牽涉太多政治」是什麼意思了。
